1. PREAMBLE AND LEGALLY BINDING EFFECT

This Privacy Policy, Data Governance Framework, Disclaimer of Warranties, Limitation of Liability, and Waiver of Claims (hereinafter collectively referred to as the “Policy”) constitutes a legally binding agreement between Narov (“Company,” “Narov,” “we,” “us,” or “our”) and any individual or entity accessing, browsing, using, or otherwise interacting with the Narov website, platforms, services, content, or infrastructure (collectively, the “Services”).

By accessing or using the Services, the User expressly acknowledges that they have read, comprehended, and irrevocably agreed to be bound by this Policy in its entirety, without limitation, reservation, or qualification.

If the User does not agree to any portion of this Policy, the User must immediately discontinue all use of the Services.


2. DEFINITIONS AND INTERPRETIVE PRINCIPLES

For purposes of interpretation, the following principles shall apply:

  • Any ambiguity shall be construed in favor of Narov.

  • Headings are for convenience only and shall not affect interpretation.

  • The terms “including,” “without limitation,” and similar phrases shall be interpreted expansively.

  • Singular includes plural and vice versa.


3. ABSOLUTE DATA OWNERSHIP AND PROHIBITION OF USE

3.1 Exclusive Ownership

All data, content, materials, insights, analytics, outputs, structures, methodologies, and derivative works made available through the Services are the exclusive intellectual, proprietary, and commercial property of Narov.

Users acquire no rights, licenses, interests, or entitlements of any kind.

3.2 Total Restriction on Data Use

Users are strictly prohibited from:

  • Copying, extracting, scraping, indexing, or mirroring data

  • Using data for training, analysis, benchmarking, or decision‑making

  • Commercializing, reselling, sublicensing, or redistributing data

  • Reverse engineering logic, systems, or outputs

  • Using data in legal, financial, medical, or strategic contexts

Any such use is unauthorized, unlawful, and constitutes a material breach.

3.3 No Reliance

Users acknowledge that no data or content provided by Narov shall be relied upon for any purpose whatsoever. Any reliance is undertaken entirely at the User’s own risk.


4. DATA COLLECTION, PROCESSING, AND INTERNAL USE

Narov may collect technical, behavioral, analytical, and operational data, including but not limited to metadata, access logs, interaction patterns, inferred preferences, and anonymized aggregates.

All such data is:

  • Collected solely for Narov’s internal purposes

  • Subject to modification, deletion, or aggregation at Narov’s discretion

  • Not guaranteed to be accurate, complete, or current

Users expressly waive any right to access, correct, delete, or object to such data, except where explicitly required by non‑waivable law.


5. CUSTOMER PROTECTION PRINCIPLES (NON‑BINDING)

5.1 Voluntary Safeguards

Narov may, at its sole discretion, implement technical and organizational measures intended to reduce unauthorized access, accidental loss, or system misuse.

5.2 No Duty, No Guarantee

These measures:

  • Do not constitute a legal obligation

  • Do not create a duty of care

  • Do not imply security, accuracy, continuity, or availability

5.3 No Assumption of Responsibility

Narov expressly disclaims any responsibility arising from User expectations regarding safety, protection, or reliability.

Customer protection efforts are courtesy-based, not rights‑based.


6. DISCLAIMER OF WARRANTIES (MAXIMUM EXTENT)

The Services are provided “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

Narov expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy or completeness

  • Non‑infringement

  • Availability, uptime, or continuity

  • Security or error‑free operation

No statement by Narov shall create any warranty.


7. LIMITATION AND EXCLUSION OF LIABILITY

To the maximum extent permitted by applicable law, Narov shall never be liable for any:

  • Direct or indirect damages

  • Incidental, consequential, or punitive damages

  • Economic loss, loss of profits, loss of opportunity

  • Reputational harm or business interruption

  • Data loss, corruption, or misuse

  • Emotional or psychological distress

  • Decisions made or actions taken by Users

This applies regardless of:

  • Legal theory (contract, tort, negligence, strict liability, etc.)

  • Foreseeability

  • Prior notice of potential harm


8. TOTAL WAIVER OF CLAIMS AND RIGHTS

By using the Services, Users irrevocably and unconditionally:

  • Waive any right to sue, arbitrate, or litigate against Narov

  • Waive participation in class actions or collective proceedings

  • Release Narov from all known and unknown claims

  • Accept sole responsibility for all outcomes of use

This waiver survives termination of use.


9. INDEMNIFICATION OBLIGATION

Users agree to indemnify, defend, and hold harmless Narov from any and all claims, liabilities, losses, damages, costs, and expenses (including attorneys’ fees) arising from:

  • Use or misuse of the Services

  • Violation of this Policy

  • Reliance on any data or content

  • Third‑party claims connected to User conduct


10. MODIFICATION, SUSPENSION, AND TERMINATION

Narov may modify, suspend, restrict, or terminate access to the Services or this Policy at any time, without notice, justification, or liability.

Continued use constitutes automatic acceptance of all modifications.


11. GOVERNING LAW AND EXCLUSIVE JURISDICTION

This Policy shall be governed by the laws of the jurisdiction in which Narov is incorporated, excluding conflict‑of‑law rules.

All disputes shall be resolved exclusively in courts selected by Narov.


12. SEVERABILITY AND SURVIVAL

If any provision is held unenforceable, it shall be severed and replaced with a lawful provision that most closely reflects the original intent.

All disclaimers, waivers, and limitations survive indefinitely.


13. FINAL ACKNOWLEDGMENT

By accessing the Services, the User affirms that:

  • They understand the risks

  • They accept all limitations

  • They waive all claims

  • They assume full responsibility
